DMCA Policy
FSM Navigator respects the intellectual property rights of others. This policy describes our procedures for responding to claims of copyright infringement under the Digital Millennium Copyright Act.
Table of Contents
1. Overview
CJD Technologies LLC (“we,” “us,” “our”), operating as FSM Navigator, respects the intellectual property rights of others and expects our users to do the same.
In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), 17 U.S.C. § 512, we will respond promptly to notices of alleged copyright infringement that comply with applicable law.
If we receive proper notification of claimed copyright infringement, we will respond by removing or disabling access to the material that is claimed to be infringing.
This policy applies to all content uploaded to or transmitted through the FSM Navigator platform by users, as outlined in our Terms of Service.
2. Designated Agent
Our designated agent for receiving DMCA notices is:
CJD Technologies LLC
3. Filing a DMCA Notice
If you believe that content on FSM Navigator infringes your copyright, please submit a written notice to our Designated Agent containing the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are covered).
- Identification of the material that is claimed to be infringing, including information reasonably sufficient to permit us to locate the material (e.g., a description of where the content appears in our Service).
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.
Notices should be sent to [email protected]. Incomplete notices may not receive a response.
WARNING: Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys’ fees.
4. Counter-Notification
If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may file a counter-notification with our Designated Agent containing the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which CJD Technologies LLC may be found).
- A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receiving a valid counter-notification, we will promptly provide the original complainant with a copy. If the original complainant does not file a court action seeking a restraining order against the content provider within ten (10) business days, we will restore the removed material.
5. Repeat Infringers
In accordance with the DMCA, we maintain a policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.
A “repeat infringer” is a user who has been the subject of more than one valid DMCA notification.
We may, at our sole discretion, limit access to the Service and/or terminate the accounts of users who infringe the intellectual property rights of others, regardless of whether there is any repeat infringement.
6. Good Faith Requirement
We process all DMCA notices and counter-notifications in good faith.
Filing a fraudulent DMCA notice or counter-notification may result in legal liability under 17 U.S.C. § 512(f).
We reserve the right to disregard notices that we determine, in good faith, to be fraudulent or not compliant with the DMCA.
We encourage parties to seek legal advice before filing notices if they are unsure whether material infringes a copyright.
7. Modifications
We may update this DMCA Policy from time to time to reflect changes in law, regulation, or our practices.
Material changes will be indicated by updating the “Last Updated” date at the top of this page.
We encourage you to review this page periodically to stay informed of our copyright procedures.
